ICE Arrested a New Yorker in a Schenectady Courthouse Without a Warrant

The arrest, supposed to be banned by a 2020 law, took place a week before a new memo to court officers advised them to step aside if ICE proceeds, sans warrant.

New York's Protect Our Courts Act, passed in 2020, is supposed to prohibit federal immigration authorities from detaining someone who is inside a state courthouse, if those agents do not have a judicial warrant or order. 

But on January 27, federal Immigration and Customs Enforcement officials arrested someone in Schenectady City Civil Court without a judicial warrant or order, according to the office of Manhattan State Senator Brad Hoylman-Sigal, who confirmed the incident with personnel at the Office of Court Administration. 

This is one of two arrests by ICE agents in New York state court facilities since January 2025, according to OCA.
